依職業安全衛生管理辦法規定，勞工人數未滿30人之事業單位 ，應置丙種職業安全衛生業務主管，惟為鼓勵微型企業雇主或其代理人親自接受相關安全衛生教育訓練，俾有助於職場安全衛生落實，爰參考日本、韓國針對微型企業雇主實施特別講習之作法，增列風險較低之第二類及第三類事業勞工人數在5人以下之事業單位，得由經丁種職業安全衛生業務主管教育訓練合格之雇主或其代理人擔任，以促使安全衛生管理權責相符。
