「職業災害勞工保護法」於91年4月28日起施行，針對未參加勞保的受僱及自營作業職災勞工提供除勞動基準法及勞工保險條例以外之補充性保障。
補助項目：
- 未加勞保受僱勞工或自營作業者遭遇職災，可依本法第9條規定請領職業疾病生活津貼、失能生活津貼、職業訓練生活津貼、器具補助、看護補助、家屬補助等補助。
- 未加勞保受僱勞工遭遇職災，雇主如未依勞動基準法規定予以職業災害補償時，可申請第6條規定的失能補助（須符合第1至第10等級）或死亡補助。
