一、依職業安全衛生教育訓練規則第4條規定，雇主對擔任營造業職業安全衛生業務主管之勞工，應於事前使其接受營造業職業安全衛生業務主管之安全衛生教育訓練；98年1月8日前，具下列資格之一，且有1年以上營造工作經歷者，得免接受前述安全衛生教育訓練：
(一)勞工安全管理師。
(二)勞工衛生管理師。
(三)勞工安全衛生管理員。
(四)經勞工安全管理師、勞工衛生管理師、勞工安全衛生管理員、勞工安全衛生業務主管訓練合格領有結業證書者。
二、因此，如領有98年1月8日以前之勞工安全衛生管理員結業證書，且於98年1月8日以前，有1年以上營造工作經歷，方得擔任營造業職業安全衛生業務主管。
