1.職業安全衛生管理辦法第89條之1規定，政府機關(構)如有其他法規限制，得於組織修編完成 前，提報職業安全衛生管理規章或職業安全衛生管理計畫，經勞動部(職安署)核定者，不受本辦法第2條之1、第3條及第6條有關設置職業安全衛生管理單位及人員之限制。勞動部已訂定「職業安全衛生管理規章及職業安全衛生管理計畫指導原則」，以提供政府機關（構）參考。
2.另相關送審作業及程序請依「政府機關（構）職業安全衛生管理規章或計畫審核作業要點」辦理。
