對於職業促發腦血管及心臟血管疾病(俗稱過勞)，我國訂有「職業促發腦血管及心臟疾病之認定參考指引」(下簡稱過勞認定參考指引)，現行係參考日本之過勞認定基準，相關認定標準與日本一致。
對於過勞之認定，係考量腦心血管疾病勞工若長期睡眠不足，其過勞促發風險將增加，至於是否屬職業因素促發腦心血管疾病，須整體評估個案是否有歷經異常的事件、短期工作負荷過重或長期工作負荷過重等各項危害因子，爰除工時因素外，尚須考量其工作型態（如不規律、夜/輪班、作業環境..）及精神負荷等其他因子，並由專科醫師就工作與疾病發生之因果關係綜合評估判斷。
勞動部職安署已將過勞認定參考指引公布於官網，並提供勞保局、各職業傷病防治中心及網絡醫院、各勞動檢查機構及勞工行政主管機關等參考運用。
