關於部分報章媒體報導，勞動部過勞預防之違規裁罰案件少，職安署特予說明。職業安全衛生法係參考先進國家作法，將過勞預防入法，明訂檢查違反者，通知限期改善，屆期未改善經複查確認，可裁罰3~15萬，期使國內企業重視與推動相關預防措施。該法於103年7月施行，考量新增相關預防措施之規定，涉及工作適性調整、健康檢查與管理，事業單位雇主與勞工均需相關規劃與準備，爰於同年9月間完成「異常工作負荷促發疾病預防指引」公告，提供業界推動過勞預防之參考與運用。
為強化對勞工之保護，本署已將過勞預防納為檢查事項，近3年經檢查，已依法函知3,385家事業單位限期改善。由於該制度之調適及落實，仍須時間因應，爰本署亦同時強化對企業之相關宣導輔導共1964場次。至外界質疑複查比率低、裁罰較少部分，職安署表示後續將就通知限期改善者積極實施複查，加強督促事業單位落實過勞預防相關措施。
