一、 職業傷病定義
職業傷病一詞分別為職業「傷害」以及職業「疾病」之意。
職業傷害： 指在執行職務時，受到立即性意外的傷害。例如在工作中於鷹架上摔落地面受傷骨折，即屬於職業傷害。
職業疾病： 指在執行職務時，因暴露於化學性、物理性、生物性、人因性以及其他因子導致身體產生疾病(經醫師診斷)。例如長期處於強烈噪音的工作環境之中，經由醫師診斷噪音所導致聽力損失，即屬於職業疾病。
二、 職業病認定之申請
依據職業災害勞工保護法第十一條與職業災害勞工保護法施行細則十八條規定，當懷疑患有職業疾病，且經醫師診斷，您或雇主對於職業疾病診斷有異議時得檢附職業疾病診斷書、既往作業之經歷、職業暴露資料、勞工體格及健康檢查紀錄、病歷、生活史及家族病史等資料，向直轄市、縣(市)主管機關申請認定。
三、 職業病鑑定之申請
依據職業災害勞工保護法第十三條規定，直轄市、縣(市)主管機關對於職業疾病認定有困難及勞工或雇主對於直轄市、縣(市)主管機關認定職業疾病之結果有異議，或勞工保險機構於審定職業疾病認有必要時，得檢附有關資料，向中央主管機關申請鑑定。
