為保障職業災害勞工之權益，加強職業災害之預防，促進就業安全及經濟發展，「職業災害勞工保護法」於民國90年10月11日由立法院三讀通過，民國90年10月31日經總統令公布，自民國91年4月28日起施行。開辦時由勞工保險局辦理，103年2月17日政府組織改造後，移由職業安全衛生署辦理。
除勞動基準法及勞工保險條例給予職災勞工保障外，本法提供職災勞工補充性之保障，補助對象包括有加勞保職災勞工及未加勞保職災勞工；有加勞保職災勞工，除勞保之職災給付外，還可依本法第8條規定請領職業疾病生活津貼、失能生活津貼、職業訓練生活津貼、器具補助、看護補助、家屬補助，退保後職業疾病生活津貼等各項補助。至未加勞保勞工發生職災事故，符合第9條規定者，亦得依規定請領前述各項補助及津貼，又，雇主如未依勞動基準法規定予以職業災害補償時，得另依該法第6條規定請領失能補助或死亡補助。
另為協助職業災害勞工於醫療終止後重返就業場所，針對僱用職業災害勞工並提供其從事工作必要之輔助設施之事業單位給予補助。
