職業安全衛生設施規則第277條之1自 109年1月1日開始施行，而呼吸防護計畫及採行措施指引自109年7月1日開始施行，兩者施行日期的差異，是為提供事業單位緩衝的時間，以依照指引規定訂出符合工作場所現況的呼吸防護計畫。因此，自109年1月1日開始，雇主使勞工使用呼吸防護具，不論事業單位規模，應依照職業安全衛生設施規則第277條之1第1項的規定，指派專人採取呼吸防護措施；而勞工人數在200人以上的事業單位，除應依照前面所提的規定辦理之外，建議可及早因應，依據指引規定訂定呼吸防護計畫，並依照計畫執行。
